Office of the Legal Advisor City of Boston - Police Department One Schroeder Plaza Boston, MA 02120 Dear Attorney Geraghty: I have received the petition of Dennis Shedd, Esq., appealing the nonresponse of the Boston Police Department (Department) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1 ). Specifically, Attorney Shedd requested copies of all reports, calculations, correspondence, notes, and other documents prepared by a specifically identified Officer regarding a motor vehicle accident that occurred on August 12, 2001. In a response dated March 1, 201 7, the Department denied his request in its entirety citing to the Criminal Offender Record Information statute and Exemptions (c) and (f) to the Public Records Law. G. L. c. 6, §§ 167-168; G. L. c. 4, § 26(c) and (f). It is my understanding that on March 10, 2017 the Department provided Attorney Shedd with responsive records along with a written supplemental response. Whereas this appeal was based on the Department's original response, I will consider this administrative appeal closed. Attorney Shedd may appeal the substantive nature of the Department's most recent response within ninety (90) days. See 950 C.M.R. 32.08(1).
