Assistant District Attorney Essex County 10 Federal St. 10th Floor Salem, MA 01970 Dear Attorney O'Sullivan: I have received the petition of Rafael Martinez appealing the nonresponse of the Essex County District Attorney's Office (Office) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Martinez requested any and all file information regarding a specifically identified incident report. Having received no response, Mr. Martinez petitioned this office. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified that a response was provided, dated March 16, 2017. Whereas this matter was opened based upon the Office's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Martinez may appeal the substantive nature of the Office's response within ninety (90) days. See 950 C.M.R. 32.08(1 ).
