Murray Supervisor ofR ecords March 24, 2017 SPR17/333 Chair Frances Parks Prudential Committee Village of Cotuit 55 High Street Cotuit, MA 02635 Dear Chair Parks: I have received the petition of Cynthia Gardner appealing the response of the Village of Cotuit Prudential Committee (Committee) to a request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Gardner requested a copy of the "January 2017 Appropriation Reports." Ms. Gardner is appealing the substantive nature of the Committee's February 14, 2017 response. In their February 2017 response, the Committee responded to Ms. Gardner's request by stating, "There was no appropriation report generated in January due to a software change." Subsequent to the intervention by a member of the Public Records Division staff, the Committee agreed to issue Ms. Gardner a supplemental response to her request. The Committee will include additional information explaining why they do not possess "January 2017 Appropriation Reports." I will now consider this administrative appeal closed with the proviso that the Committee issues Ms. Gardner a supplemental response to her request without delay. Ms. Gardner may appeal the substantive nature of the Committee's response within ninety (90) days. See 950 C.M.R. 32.08(1).
