Records Access Officer Lowell Public Schools 155 Merrimack Street Lowell, MA 01852 Dear Attorney Ortiz: I have received the petition of Gerry Nutter appealing the nomesponse of the Lowell Public Schools (School) to a request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Nutter requested a list of all grant money during the 2015/2016 school year. Having received no response, Mr. Nutter petitioned this office. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified that a response will be provided. Please note, a records access officer shall not charge a fee for a public record unless the records access officer responded to the requester within 10 business days. G.L. c. 66, § lO(e). Whereas this matter was opened based upon the School's failure to provide a written response, I will now consider this administrative appeal closed with the proviso the School provides Mr. Nutter with a response without delay. Mr. Nutter may appeal the substantive nature of the School's response within ninety (90) days. See 950 C.M.R. 32.08(1).
