Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Paul Campagna appealing the nonresponse of the Massachusetts Department of Transportation (MassDOT) to his request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Campagna requested "[A]ll communications, notes, or documentation alluding to any communication made by any media (paper, email, telecommunication or any other media)" between MassDOT and another specifically identified state agency in relation to "[C]omplainant in the subject action, Paul Campagna." Having received no response, Mr. Campagna petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a member of the Public Records Division staff, it was discovered that the proper agents within MassDOT responsible for handling and processing requests for records never received Mr. Campagna's initial request. After a staff member within this office provided MassDOT with a copy of the request, a representative from MassDOT acknowledged the request and expressed his willingness to provide a response. Whereas this matter was opened based upon MassDOT's failure to provide a written response, I will now consider this administrative appeal closed with the proviso that the MassDOT provide Mr. Campagna with a response within ten (10) business days. Mr. Campagna may appeal the substantive nature of MassDOT's response within ninety (90) days. See 950 C.M.R. 32.08(2). Sincerely, ~~ Rebecca S.
