The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor ofR ecords March 23, 2017 SPR17/366 Myrna Solod Records Access Officer Massachusetts Commission Against Discrimination One Ashburton Place, Room 601 Boston, MA 02108 Dear Ms. Solod: I have received the petition of Paul Campagna appealing the response of the Massachusetts Commission Against Discrimination (MCAD) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Campagna requested "[A]ll communications, notes, or documentation alluding to any communication made by any media (paper, email, telecommunication or any other media)" between MCAD and another specifically identified state agency in relation to "[C]omplainant in the subject action, Paul Campagna." Mr. Campagna notes that he received a response via telecommunication from MCAD in which a representative informed him that "they had no documents fitting the description in the request." Mr. Campagna claims to have informed the agent from MCAD that he expected a letter memorializing this finding, but claims to have not yet received anything to date. Having received no written response from MCAD, Mr. Campagna petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that MCAD intends to provide Mr. Campagna with a written response. Accordingly, I will consider this administrative appeal closed with the proviso that MCAD provide said response within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Campagna may appeal the substantive nature of MCAD's response within ninety (90) days. See C.M.R. 32.08(1). Sincerely, ~M~ Supervisor of Records cc: Paul Campagna One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre• pre@sec.state.ma.us
