Cutler, Jr. Town Clerk Town of Foxborough 40 South Street Foxborough, MA 02035 Dear Mr. Cutler: I have received the petition of Peter Chipman appealing the nonresponse of the Town of Foxborough Town Clerk (Town) to his request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Chipman requested "the CY16 employee's wages, including the special officer's pay" in a specific format. Having received no response, Mr. Chipman petitioned this office. Subsequent to the intervention by a staff member of the Public Records Division, it was discovered that the proper agent for handling such a request never received Mr. Chipman's inquiry. Nonetheless, a representative from the Town indicated their willingness to provide a response. In a conversation with the Public Records staff member, the Town informed this office that they do not have the requested records in the desired format that Mr. Chipman preferred, but are willing to share all pertinent data. Whereas this matter was opened based upon the Town's failure to provide a written response, I will now consider this administrative appeal closed with the proviso that the Town provide Mr. Chipman with a written response within ten (10) business days. It is preferable to send an electronic copy of this response to this office at: pre@sec.state.ma.us. Mr. Chipman may appeal the substantive nature of the Town's response within ninety (90) days.
