Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Paul Campagna appealing the nonresponse of the Massachusetts Department of Transportation (MassDOT) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Campagna requested "[A]ll communications, notes, or documentation alluding to any communication made by any media (paper, email, telecommunication or any other media" between MassDOT and another specifically identified state agency in relation to "[C]omplaint in the subjection action, Paul Campagna." This request was subject to a previous appeal and determination. See SPRl 7/365 Determination of the Supervisor of Records (March 22, 2017). This office closed that appeal with the understanding that the Department would provide a response to Mr. Campagna within ten (10) business days. Claiming to not yet have received a response, Mr. Campagna petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from MassDOT intends on providing a response within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Campagna may appeal the substantive nature of MassDOT's response within ninety (90) days.
