Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Raymond Sarno appealing the response of the Massachusetts Department of Transportation (MassDOT) to his request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Sarno requested a copy of a particular complaint, which resulted in an administrative hearing. Mr. Sarno received a copy of the requested record but took issue with the level of redactions made to the file. Mr. Sarno petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a member of the Public Records Division staff, it was determined that the proper agent within MassDOT responsible for handling and processing these requests for records never received Mr. Sarno's request. After a staff member within this office provided MassDOT with a copy of the request, a representative from MassDOT acknowledged the request and expressed his willingness to provide a response. I learned that MassDOT intends to provide a response no later than April 21, 201 7. I will consider this administrative appeal closed with the proviso that MassDOT provide Mr. Sarno with a response within ten (10) business days. Mr. Sarno may appeal the substantive nature of MassDOT's response within ninety (90) days. See 950 C.M.R. 32.08(2). Sincerely, ~ Rebecca S.
