Senior Counsel Office of General Counsel Department of Environmental Protection One Winter Street, 3rd Floor Boston, MA 02108 Dear Attorney Delaplain: I have received the petition of Caitlin Russell appealing the response of the Department of Environmental Protection (MassDEP) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Russell requested "the most recent map of sewer systems in Massachusetts." In a response dated March 9, 2017, Edmund J. Coletta of MassDEP notified Ms. Russell that MassDEP was now working on responding to her request and that she would be notified when the response was complete. Ms. Russell received no further written response to this request and petitioned this office; as a result SPR 17 /534 was opened. Subsequent to the intervention by a member of the Public Records Division staff, this office was notified that a final response was provided to Ms. Russell dated March 20, 2017. Therefore, whereas this matter was opened based upon MassDEP's failure to provide a final written response, I will now consider this administrative appeal closed. Ms. Russell may appeal the substantive nature of MassDEP's response within ninety (90) days. See C.M.R. 32.08(1). Sincerely, Rebecca S.
