Records Access Officer Massachusetts Department of Transportation 10 Park Plaza, Room 7760 Boston, MA 02116 Dear Attorney Krupanski: I have received the petition of Heather Carit o appealing the nonresponse of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Carito requested "[m]eeting notes, reports, and emails" from specifically identified individuals concerning a ventilation study, overpass jet fans, emergency exhaust fans at a specific train station, as well as "Casey Arborway exhaust fans, Casey Arborway public meeting, and Casey Arborway Schedule Adjustment." Claiming to not yet have received a response, Ms. Carito petitioned this office. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the MBTA intends on providing Ms. Carito with a response. Accordingly, I will now consider this administrative appeal closed with the proviso that the MBTA provide said response within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Carito may appeal the substantive nature of the Department's response within ninety (90) days.
