Coleman: I have received the petition of Attorney Murat Erkan appealing the nonresponse of the Lynn Police Department (Department) to a request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Attorney Erkan requested "any Lynn Police Department policies, effective on 11/28/16 relative to traffic enforcement stops, safety procedures during traffic stops, report writing, and evidence collection procedures." Claiming to not yet have received a response, Attorney Erkan petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent designated for handling requests for records never received Attorney Erkan's request. Nonetheless, a representative from the Department indicated his willingness to provide a response. Accordingly, I will now consider this administrative appeal closed with the proviso that the Department provide said response within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre(a),sec.state.ma.us.
