Silvia Records Access Officer Department of Correction - Headquarters 50 Maple Street, Suite 3 Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Benjamin Silva appealing the nonresponse of the Department of Correction (Department) to a request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Silva requested a copy of "any and all statistical data quantifying the total number of sexual assaults reported annually within each Department of Correction facility, starting at calendar year 2000, and including each subsequent year through calendar year 2016." Claiming to not yet have received a response, Mr. Silva petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department responded to Mr. Silva's request with a response sent on April 20, 2017. Whereas the basis of this appeal was opened as a result of the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Silva may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08. Sincerely, Rebecca S.
