DeMaio Boston Police Department One Schroeder Plaza Boston, MA 02120 Dear Ms. DeMaio: I have received the petition of Chris Fitzgerald appealing the response of the Boston Police Department (Department) to his request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Fitzgerald requested all reports that correlate with an identified article published in The Boston Herald. Unsatisfied with the Department's response, which notes the Department's intention to withhold the requested records, Mr. Fitzgerald petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a member of the Public Records Division staff, I learned that a representative from the City of Boston, in conjunction with agents of the Department, intend of providing Mr. Fitzgerald with a response to his appeal. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide Mr. Fitzgerald with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Fitzgerald may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2). Sincerely, ~~ Rebecca S.
