DeMaio Boston Police Department One Schroeder Plaza Boston, MA 02120 Dear Ms. DeMaio: I have received the petition of David Sellers appealing the response of the Boston Police Department (Department) to his request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Sellers requested various logs within the possession of the Department. Unsatisfied with the Department's response, which notes the City's intention to withhold the requested records, Mr. Sellers petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a member of the Public Records Division staff, I learned that a representative from the City of Boston, in conjunction with agents of the Department, intend on providing Mr. Sellers with a response to his appeal. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide Mr. Sellers with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Sellers may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2).
