Carbone Town of Barre-Police Department 40 West Street Barre, MA 01005 Dear Chief Carbone: I have received the petition of Samuel Lipson of appealing the response of the Town of Barre - Police Department (Department) to his request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Lipson requested copies ofrecords regarding a report of a specifically identified incident. Unsatisfied with the Department's response, Mr. Lipson petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a member of the Public Records Division staff, I learned that the Department intends on providing Mr. Lipson with a supplemental response to his request. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide Mr. Lipson with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Lipson may appeal the substantive nature of the Department's response within ninety (90) days.
