The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records Mayll,2017 SPR17/624 Jeanine Roth Records Manager Department of Corrections MCI-Concord 965 Elm Street P.O. Box 9106 Concord, MA O1 74 2 Dear Ms. Roth: I have received the petition of Emory A. Snell, Jr. appealing a non-response within ten (10) days of the Department of Correction MCI-Concord (Department) to his March 30, 2017 request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Snell requested records in whatever form of twelve itemized categories and sub-parts of those categories relating to indigent mail and asbestos. Mr. Snell petitioned this office, stating that he did not receive a response. On May 10, 2017, you notified the Public Records Division staff that responses were provided to Mr. Snell on April 14tl1, the day that the request was received by the Records Access Officer, and again on April 28th to accompany the responsive records the Department provided to Mr. Snell. Whereas this matter was opened based upon Mr. Snell's petition that no response was provided, seeing that responses were provided, I now consider this administrative appeal closed. Mr. Snell may appeal the substantive nature of the Department's April 28th response within ninety (90) days. See 9?0 C.M.R. 32.08(1). Sincerely, ~ u r r ~ Supervisor of Records cc: Emory A.
