Murray Supervisor ofR ecords May 12, 2017 SPR17/659 Myrna Solod Records Access Officer Massachusetts Commission Against Discrimination One Ashburton Place, Room 601 Boston, MA 02108 Dear Ms. Solod: I have received the petition of Attorney Stephen Perry appealing the nonresponse of the Massachusetts Commission Against Discrimination (MCAD) to a request for public records. G. L. c. 66 § IOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Perry requested "a copy of all publicly available charges of discrimination" made by an identified individual, as well as "the disposition of those charges." Claiming to not yet have received a response, Attorney Perry petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after MCAD was made aware of this appeal, a representative within MCAD noted the Commission's willingness to provide a response. Accordingly, I will consider this administrative appeal closed with the proviso that MCAD provide said response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Perry may appeal the substantive nature of MCAD's response within ninety days.
