Office of the General Counsel Massachusetts Department of Transportation Ten Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Heather Carit o appealing the nomesponse of the Massachusetts Department of Transportation (MassDOT) to her request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, on March 24, 2017, Ms. Carito requested "[m Jeeting notes, reports, and email[ s] " from specifically identified individuals regarding a ventilation study, overpass jet fans, and emergency exhaust fans, as well as "[the] Casey Arborway public meeting, Casey Arborway Schedule Adjustment, and changes to the upper busway and bus canopy between April 6, 2015 and July 20, 2016." Claiming to not yet have received the responsive records as of yet, Ms. Carito petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a member of the Public Records Division staff, I learned that the delay in response stems from a technical difficulty. The appropriate Information Technology Department has been notified of the situation and representatives from MassDOT intend on having a response to Ms. Carito on or before May 26, 2017. Accordingly, I will consider this administrative appeal closed with the proviso that MassDOT provide Ms. Carito with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre{Cl{sec.state.ma.us. Ms. Carito may appeal the substantive nature of MassDOT's response within ninety (90) days.
