General Counsel Massachusetts Department of Transportation 10 Park Plaza Suite 35 10 Boston, MA 021 16 Dear Attorney Doyle: I have received the petition of Edward Wagner appealing the nonresponse of the Massachusetts Department of Transportation (MassDOT) to a request for public records. G. L. c. 66 5 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Wagner requested "Casey Arborway contractor Barletta Reports, Contract #8 1678, schedule updates for March, April, and May, and TEA March through May." Claiming to not have received a response, Mr. MJagner petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from MassDOT intends to provide Mr. Wagner with a response. Accordingly, I will now consider this administrative appeal closed with the proviso that h/lassDOT provide said response within ten business days. Mr. Wagner may appeal the substantive nature of MassDOT's response within ninetj~(9 0) days. 950 C.M.R. 32.03(1) Sincerely, Rebecca S.
