Murray Supervisor ofR ecords June 2, 2017 SPR17/740 Cindy Livingstone Assistant Town Clerk Town of Ashland 101 Main Street Ashland, MA O1 721 Dear Ms. Livingstone: I have received the petition of Stephen Morgan appealing the response of the Ashland Town Clerk's Office (Town) to a request for public records. G. L. c. 66 § IOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Morgan requested records related to "the bond terms which should show the penalty for early payment." Unsatisfied with the Town's latest response, Mr. Morgan petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Town responded to Mr. Morgan's request with a response sent on May 24, 2017. Furthermore, Mr. Morgan received an ancillary email from the Director of Finance within the Town in which she specified "[t]here is no record that shows that the CPC is not allowed to pay down its projects related bonds early." She also noted that it is possible to "pay down bonds early, if budgeted for and if funds are available. At this time, the CPA Fund does not have ,adequate funds to pay down its bonds." Given that the Town has provided a subsequent response, accordingly, I will now consider this administrative appeal closed. Sincerely, ~~ Rebecca S.
