Flanagan Town Manager Town of Andover 36 Bartlet Street Andover, MA 01810 Dear Mr. Flanagan: I have received the petition of Kim Sherwood appealing the response of the Andover Town Manager (Town) to her request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Ms. Sherwood requested "copies of all correspondence between the Selectmen/Town Manager and the Spring Grove Cemetery Commission for the period of May 1, 2015 to date." Unsatisfied with the Town's latest response, which notes the intention to withhold the redacted information under Exemption ( o ), Ms. Sherwood petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that an agent of the town, in conjunction with the Town Manager, intends on providing Ms. Sherwood with a response to this appeal. Accordingly, I will consider this administrative appeal closed with the proviso that the Town provide Ms. Sherwood with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Sherwood may appeal the substantive nature of the Town's response within ninety (90) days.
