The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records June 7, 2017 SPR17/770 Ira Gant, Esq. Dear Attorney Gant: This office has received your original request to the Massachusetts Department of State Police (Department) inquiring for records. After reviewing this information I find that I am unable to accept your appeal. The Public Records Access Regulations, which govern the procedural aspects of all appeals, provide records custodians with ten (10) business days in which a response to a public records request must be provided. See 950 C.M.R. 32.06 (2) (b ); G.L. c. 66, § 1O (b ). The 10-day time frame in which a custodian must respond had not yet elapsed when your appeal was submitted. Whereas your original request was submitted on May 23, the soonest you would be able to appeal on the grounds of nonresponse would be June 8, 2017. If after 10-business days have passed and the Department denies your request or fails to respond, you may appeal to this office. At that time this office will review the matter. Sincerely, ~~ Rebecca S. Murray Supervisor of Records cc: Sean W. Farrell, Esq.
