Clifford and Kenny, LLP 31 Schoose:tt Street, Unit 405 Pembroke, MA 02359 Dear Attorney Kenny: I have received the petition of Patrick Stewart appealing the nonresponse of the Scituate Police Department (Department) to his request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Stewart requested various categories of personnel records. Claiming to not yet have received a response, Mr. Stewart petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department contacted an attorney representing Mr. Stewart in an effort to inform him that the records are prepared and may be attained by retrieving them from a specifically identified location. It appears that Mr. Stewart never received this message. As such, an agent of the Department informed this office that they plan to contact Mr. Stewart directly to share this information. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide Mr. Stewart with a response. within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Stewart may appeal the substantive nature of the Department's response within ninety (90) days.
