Massachusetts Department of Transportation Office of the General Counsel 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Heather Carito appealing the nonresponse of the Massachusetts Department of Transportation (MassDOT) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, on March 24, 2017, Ms. Carito requested "[m]eeting notes, reports, and email[ s ]" from identified individuals regarding a ventilation study, overpass jet fans, and emergency exhaust fans, as well as "[the] Casey Arborway public meeting, Casey Arborway Schedule Adjustment, and changes to the upper busway and bus canopy between April 6, 2015 and July 20, 2016." Claiming to not yet have received the responsive records, Ms. Carito petitioned this office and this appeal was opened as a result. It should be noted that this appeal is related to two previous appeals in which Ms. Carito claims to have not received records. See SPRl 7/548 Determination of the Supervisor of Records (April 27, 2017); SPRl 7/693 Determination of the Supervisor of Records (May 22, 2017). Subsequent to the intervention by a staff member of the Public Records Division, I learned that MassDOT responded to Ms. Carita's request with a response sent on June 8, 2017. Whereas this appeal was opened as a result of MassDOT' s failure to provide a substantive written response, I will now consider this administrative appeal closed. Ms. Carito may appeal the substantive nature of MassDOT's response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, ~~ Rebecca S.
