Massachusetts Department of Transportation Office of the General Counsel 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Russell Seelig appealing the nonresponse of the Massachusetts Department of Transportation (MassDOT) to his request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Seelig requested "a viewing of the contracts/ agreements/ etc. between the DOT and the entities that own/ operate/ lease the cell tower installations seen along the Massachusetts Turnpike." Claiming to not yet have received a response, Mr. Seelig petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from MassDOT intends on providing Mr. Seelig with a response to his appeal. Accordingly, I will consider this administrative appeal closed with the proviso that MassDOT provide Mr. Seelig with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre(a),sec.state.ma.us. Mr. Seelig may appeal the substantive nature of MassDOT's response within ninety (90) days.
