Staff Counsel Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Brunelli: I have received the petition of Attorney Ira Gant appealing the nonresponse of the Massachusetts Department of State Police (Department) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Gant requested "[a]ny and all documentation related to the chain-of-custody of biological items or physical evidence, either collected as evidence or stored as evidence by the MSP CPAC Unit, Norfolk DA's Detective Unit, or other MSP investigative unit." Claiming to not yet have received a response, Attorney Gant petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department responded to Attorney Gant's request with a response sent on June 8, 2017. Whereas the basis of this appeal was opened as a result of the Department's failure to provide a written response, I will now consider this administrative appeal closed.
