Director of Public Records City of Boston 1 City Hall Plaza, Room 615 Boston, MA 02201 Dear Attorney Williams: I have received the petition of Michael Lodge appealing the nonresponse of the Boston Police Department (Department) to his request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Lodge requested various records related to a crime scene, including photographs, witness statements, and "35mm negatives." Unsatisfied with the Department's response, which notes the intention to withhold said documents under Exemption (g), Mr. Lodge petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a member of the Public Records Division staff, I learned that a representative from the City of Boston coordinated with the Department and intends on providing Mr. Lodge with a response to his appeal. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide Mr. Lodge with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Lodge may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(1).
