Sunderland, Jr. appealing the nonresponse of the City of Haverhill (City) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Sunderland requested a copy of a report in which he believes he is the subject. Claiming to not yet have received a response, Attorney Sunderland petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member ofthe Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the City was made aware of this appeal, a representative within the City noted their willingness to provide a response. Accordingly, I will consider this administrative appeal closed with the proviso that the City provide said response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Sunderland may appeal the substantive nature of the City's response within ninety days.
