Massachusetts Department of Transportation Office of the General Counsel Ten Park Plaza, Suite 3 5 10 Boston, MA 02 1 16 Dear Attorney Doyle: I have received the petition of Edward Wagner appealing the nonresponse of the r\4assachusetts Department of Transportation (MassDOT) to a request for public records. G. L. c. 66 5 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Wagner requested "Casey Arbonvay contractor Barletta reports, Contract #8 1678, Schedule Updates for March, April, and May and TEA March through May." Claiming to not yet have received a response, Mr. Wagner petitioned this off~cean d this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that MassDOT responded to Mr. Wagner's request with a response sent via email on June 23, 201 7. Whereas the basis of this appeal was opened as a result of MassDOT's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Wagner may appeal the substantive nature of MassDOT's response within ninety (90) days. See 950 C.M.R. 32.08.(1) Sincerely: - Rebecca S.
