Assistant General Counsel Executive Office of Public Safety and Security One Ashburton Place, Room 2133 Boston, MA 02108 Dear Attorney Sullivan: I have received the petition of Robert Anderson appealing the response of the Executive Office of Public Safety and Security (Office) to his request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Anderson requested nine categories of records, as well as two categories of records containing statistical data. Unsatisfied with the Office's response, which encouraged Mr. Anderson to redirect his inquiry to the Department of Corrections (Department), Mr. Anderson petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Office intends on providing Mr. Anderson with a response to his request. Accordingly, I will consider this administrative appeal closed with the proviso that the Office provide Mr. Anderson with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Anderson may appeal the substantive nature of the Office's response within ninety (90) days.
