The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records July 11, 2017 SPR17/884 Shawn Williams, Esq. Director -Records Access Officer Boston Public Records Department 1 City Hall Square Boston, MA 0220 1 Dear Attorney Williams: I have received the petition of Sean Thomas appealing the response of the Boston Police Department (Department) to a request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Thomas requested for copies of documentation involving an identified proceeding. On May 24, 2017, the Department issued a response denying the request, claiming the responsive record is exempt from disclosure under G.L. c. 41, § 97D and G.L. c. 265, § 24C as they operate through Exemption (a) of the Public Records Law. G.L. c.4, § 7(26)(a). Unsatisfied with the Department's response, Mr. Thomas petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a Public Records Division staff attorney, I learned that the Department intends to provide Mr. Thomas with a response to his request. I will now consider this administrative appeal closed with the proviso that the Department provides said response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Thomas may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, ~~ Supervisor of Records cc: Sean Thomas One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us
