Murray Supervisor ofR ecords July 5, 2017 SPR17/905 Donna Swanson Records Manager Massachusetts Treatment Center 30 Administration Road Bridgewater, MA 02324 Dear Ms. Swanson: I have received the petition of Benjamin Silva appealing the nonresponse of the Massachusetts Treatment Center (Center) to a request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Silva requested four categories of records that he believes are in the possession of the Center. Claiming to not yet have received a response, Mr. Silva petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member ofthe Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the Center was made aware of this appeal, a representative within the Center noted their willingness to provide a response. Accordingly, I will consider this administrative appeal closed with the proviso that the Center provide said response without delay. It is preferable to send an electronic copy of this response to this office at pretmsec.state.ma.us. Mr. Silva may appeal the substantive nature of the Center's response within ninety days. See C.M.R. 32.08(1).
