Assistant District Attorney Bristol County District Attorney's Office 888 Purchase Street New Bedford, MA 02740 Dear Attorney Cho: I have received the petition of Josh Fenton of GoLocal24 appealing the nonresponse of the Bristol County District Attorney's Office (DAO) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Fenton requested the complete file relating to the death of an identified individual. Claiming to not yet have received a response, Mr. Fenton petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the DAO was made aware of this appeal, a representative within the DAO noted their willingness to provide a response. Accordingly, I will consider this administrative appeal closed with the proviso that the DAO provide said response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Fenton may appeal the substantive nature of the DAO's response within ninety days.
