Murray Supervisor of Records June 11, 2017 SPR17/912 Michelle Ciccketti Deputy Superintendent of Operations Office Massachusetts Department of Correction 2 Clark Street Norfolk, MA 02056 Dear Ms. Ciccketti: I have received the petition of Jose Rodriguez appealing the nonresponse of the Depmiment of Corrections-MCI Norfolk (Department) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Rodriguez requested a copy of a document that contains his signature for "legal mail pickup at the CSD building on the morning of May 23, 2017." Claiming to not yet have received a response, Mr. Rodriguez petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the Department was made aware of this appeal, a representative within the Department noted their willingness to provide a response. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide said response within ten business days. It is preferable to send an electronic copy of this response to this office at pre0J,sec.state.ma.us. Mr. Rodriguez may appeal the substantive nature ofthe Department's response within ninety days.
