Murray Supervisor ofR ecords July 12, 2017 SPR17/931 Andrew Dew Dear Mr. Dew: This office has received your email appealing the non-response of the Boston Police Department (Department) to your request for several records. After reviewing this information I find that I am unable to accept your appeal. The Public Records Access Regulations, which govern the procedural aspects of all appeals, require that an appeal to this office be filed within ninety days of the date ofthe request letter, or within ninety days ofthe date of a written response from the record custodian. See 950 C.M.R. 32.08 (l)(d); 950 C.M.R. 32.08 (l)(e). The attachments you provided with your appeal have exceeded the ninety day limit. In particular, it is unclear when you submitted your appeal. This office is statutorily charged with determining the public records status of government records. It is not a warehouse for all government records; therefore, this office does not have custody of any records responsive to your request. This office is the custodian of records solely related to the operation of the Public Records Division. Each governmental entity in the Commonwealth of Massachusetts (Commonwealth) retains control of its own records. Accordingly, you must direct your request to the governmental entity that created or received the records you seek. In this instance, contact the city of Boston's records access officer. They may be able to assist you.
