G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Sarno took issue with what he believes is an omission of records he should have already received; specifically an "Immediate Threat Revocation Form." Unsatisfied with MassDOT's previous response, Mr. Sarno petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from MassDOT intends to provide Mr. Sarno with a response which specifically addresses the concerns that were expressed in his appeal. Accordingly, I will consider this administrative appeal closed with the proviso that MassDOT provide Mr. Sarno with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre(a)sec.state.ma.us. Mr. Sarno may appeal the substantive nature of MassDOT's response within ninety (90) days.
