Massachusetts Department of Transportation Office of the General Counsel 10 Park Plaza, Suite 3 510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Heather Carito appealing the response of the Massachusetts Department of Transportation (MassDOT) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Carito took issue with what she believes are omissions made to records she already received relating to a prior request. Ms. Carito identified seven different records she believes she is still owed by MassDOT. Unsatisfied with MassDOT's response, Ms. Carito petitioned this office and this appeal was opened as a result in an effort to gain the remaining records. Subsequent to the intervention by a staff member of the Public Records Division, I learned that MassDOT responded to Ms. Carito's appeal with a response sent via email on July 13, 2017 with the purpose of addressing her concerns. Accordingly, I will consider this administrative appeal closed. Ms. Carito may appeal the substantive nature of MassDOT' s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
