Records Access Officer Massachusetts National Guard - Joint Force Headquarters 2 Randolph Road Hanscom Air Force Base Dear Attorney Cullen: I have received the petition of Benjamin Silva appealing the nonresponse of the Massachusetts National Guard (Guard) to a request for public records. G. L. c. 66 5 10A; see 950 C.M.R. 32.08(1). Specifically, Mr. Silva requested "a paper copy of the section of the U.S. Army Chaplain's Handbook pertaining to the section of Wicca." Claiming to not yet have received a response, Mr. Silva petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the Guard was made aware of this appeal, a representative within the Guard noted their intention to provide a response. Accordingly, I will consider this administrative appeal closed with the proviso that the Guard provide said response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr Silva may appeal the substantive nature of the Guard's response within ninety days.
