Armstrong Chief of Police Town ofHolden 1204 Main Street Holden, MA 01520 Dear Chief Armstrong: I have received the petition of Michael Dreslinski appealing the nomesponse of the Holden Police Department (Department) to a request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Dreslinski requested two categories of records which he believes are in the possession of the Department. Claiming to not yet have received a response, Mr. Dreslinski petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the Department was made aware of this appeal, a representative within the Department noted their willingness to provide a response. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide said response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Dreslinski may appeal the substantive nature of the Department's response within ninety days.
