Murray Supervisor of Records August 1, 2017 SPR17/1031 Jacqueline Reis Media Relations Coordinator Department of Elementary & Secondary Education 75 Pleasant Street Malden, MA 02148 Dear Ms. Reis: I have received the petition of Todd Feathers of The Lowell Sun appealing the nonresponse of the Department of Elementary and Secondary Education (Department) to his request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Feathers requested two categories of specifically identified records which he believes are in the possession of the Department. Claiming to not yet have received a substantive response, Mr. Feathers petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department intends on providing Mr. Feathers with a response to his request. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide Mr. Feathers with a response without delay. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Feathers may appeal the substantive nature of the Department's response within ninety days.
