Records Access Officer Office of the General Counsel Massachusetts Department of Transportation Ten Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of John Hawkinson appealing the nomesponse of the Massachusetts Department of Transportation (MassDOT) to his request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Hawkinson requested various records from MassDOT including: an "approved Traffic Management Plan", correspondence from agents of MassDOT concerning communications with elected officials, as well as other reports, data, and analysis. Claiming to not yet have received a response, Mr. Hawkinson petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from MassDOT has "completed assembly of the records" and intends on providing them to Mr. Hawkinson via mail no later than August 16, 2017. Accordingly, I will consider this administrative appeal closed with the proviso that MassDOT provide Mr. Hawkinson with said response without delay. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Hawkinson may appeal the substantive nature ofMassDOT'sresponse within ninety days. See 950 C.M.R. 32.08(1).
