Murray Supervisor ofR ecords August 8, 2017 SPR17/1068 Myrna Solod Records Access Officer Massachusetts Commission Against Discrimination One Ashb urton Place, Room 601 Boston, MA 02108 Dear Ms. Solod: I have received the petition of Aliana Brodmann von Richthofen appealing the nonresponse of the Massachusetts Commission Against Discrimination (MCAD) to her request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. von Richthofen requested the assistance of this office to persuade MCAD to edit documents in their possession reflecting a specific investigation, or lack thereof. A representative from this office shared a copy of Ms. von Richthofen's appeal with an agent of the MCAD. Subsequent to the intervention by a member of the Public Records Division staff, I learned that MCAD intends to provide Ms. von Richthofen with a response to her appeal in an effort to address her concerns. Accordingly, I will consider this administrative appeal closed with the proviso that MCAD provide Ms. von Richthofen with a response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. von Richthofen may appeal the substantive nature ofMCAD's response within ninety (90) days.
