General Counsel Executive Office ofEnergy and Environmental Affairs 100 Cambridge Street, Suite 900 Boston, MA 02114 Dear Attorney Kim: I have received the petition of Todd Feathers of The Lowell Sun appealing the response of the Executive Office of Energy and Environmental Affairs (EOEEA) to his request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Feathers requested "copies of all emails sent or received since Jan. 1, 2015" by three identified Environmental Police Officers. Unsatisfied with the EOEEA's response, which notes their intention to provide the requested records on or about September 15, 2017, Mr. Feathers petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the EOEEA has compiled the records and intends on providing them to Mr. Feathers. Accordingly, I will consider this administrative appeal closed with the proviso that the EOEEA provide Mr. Feathers with said response within ten business days, It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
