Silvia Records Access Officer Department of Correction 50 Maple Street, Suite 3 Milford, MA O1 7 5 7 Dear Ms. Silvia: I have received the petition of Benjamin Silva appealing the nonresponse of the Department of Correction (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Silva requested "[t]he most up-to-date contract between the Massachusetts Dept. of Correction and Forensic Health Services to manage the Sex Offender Treatment Program (SOTP)" as well as "[a]ll previous contracts between the Massachusetts Dept. of Correction and Forensic Health Services." Claiming to not yet have received a response, Mr. Silva petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department responded to Mr. Silva's request with a response sent on August 18, 2017. Whereas the basis of this appeal was opened as a result of the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Silva may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1). Rebecca S.
