Department of State Police Office of the Chief Legal Counsel 470 Worcester Road Framingham, MA 01702 Dear Attorney Farrell: I have received the petition of Joseph F. Krowski, Esq. appealing the response of the Department of State Police (Department) to a request for public records. G. L. c. 66, § 1 OA; see also 950 C.M.R. 32.08(1 ). Specifically, Attorney Krowski requested a copy of an accident report occurring on December 12, 2016. Initially, on August 18, 2017, Department Trooper Alena V. Sullivan of the Department's Accident Reconstruction Unit withheld the report under Exemption (f), as the investigation had not been finalized and the report was incomplete. Attorney Krowski appealed to this office the Department's response. In an August 29th email, you informed an attorney in the Public Records Division that the report is complete and will be provided to Attorney Krowski along with a response. It is my understanding that the Department will copy this office on its response. Accordingly, whereas the Department has indicated it will provide the responsive record to Attorney Krowski, I will consider this appeal closed with the proviso that the Department will provide a response in a manner consistent with this order, the Public Records Law and its Regulations within ten (1 0) business days.
