Legal Counsel Massachusetts State Police Crime Lab 124 Acton Street Maynard, MA 01754 Dear Attorney Collins: I have received the petition of Jamie Folk appealing the nonresponse of the Massachusetts State Police Crime Lab (Lab) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Folk requested "a copy of Cathleen Morrison's informal audit of the Amherst drug lab from 01Jul12 and friendly audit 100ct12. Any notes or emails about the audit," "Nancy Brook[']s notes and emails regarding the 100ct12 Audit of the Amherst lab" and "any notes or emails regarding James Hanchett's interview with QA representative on 07 Aug12." Having received no response, Mr. Folk petitioned this office. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Lab intends on providing Mr. Folk with a response. Accordingly, I will now consider this administrative appeal closed with the proviso that the Lab provides said response within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Folk may appeal the substantive nature of the Lab's response within ninety (90) days.
