Mason appealing the response of the Worcester Regional Transit Authority (WRTA) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Mason requested a copy of a video recording that is believed to be in the possession of the WRT A. Prior appeal The responsive video record was the subject of a prior appeal. See SPR17/ 877 Determination of the Supervisor of Records (July 12, 2017). In my July determination, I asked the WRT A to explain why the video recording could not be provided to Ms. Mason and to explain the relationship between the WRTA and the Central Mass Transit Management, Inc. (CMTM). Attorney Randazzo indicated that without waiving its Exemption (n) or any other applicable exemption claims to any and all other public records requests, she will request the video record from CMTM and provide to Ms. Mason a copy. It is my understanding that the WRTA will waive any applicable fees that it otherwise would be allowed to charge under the Public Records Law. Conclusion Accordingly, whereas the WRTA's Legal Counsel has indicated Ms. Mason will be provided with the responsive record, I consider this appeal closed with the proviso that such a response is provided to Ms. Mason in a manner consistent with the Public Records Law and its Regulations as soon as practicable.
