Silvia Records Access Officer Department of Correction 50 Maple Street, Suite 3 Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Robert Ferris appealing the nomesponse of the Massachusetts Department of Correction (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Ferris requested copies oftwo identified incident reports and four photographs within the possession of the Department. Claiming to not yet have received a response, Mr. Ferris petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the proper agent for handling public record requests never saw the inquiry. Nonetheless, after the Department was made aware of this appeal, a representative within the Department noted their willingness to provide a response. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provide said response within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Perry may appeal the substantive nature of the Department's response within ninety days.
