Box 9106 Concord, MA01742 Dear Ms. Roth: I have received the petition of Thomas Flannery appealing the nonresponse of the Department of Correction-MCI Concord (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Flannery requested four categories of records of which he believes the Department is in possession. Claiming to not yet have received a response, Mr. Flannery petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department responded to Mr. Flannery's request with a response sent on September 14, 2017. Whereas the basis of this appeal was opened as a result of the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Flannery may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, ~~ Rebecca S.
